DUI: DID YOU KNOW?

  • A police officer makes a decision to arrest a person for DUI based on his or her personal observations.
  • A person is not allowed to show they are not under the influence by providing a breath sample prior to being arrested.
  • A police officer does not have to tell you are are allowed to refuse field sobriety tests.
  • If you refuse to blow into the breath test machine and your license is suspended you are eligible for a temporary license.
  • Innocent people can fail field sobriety tests.
  • Even if you blow under .08% you can still be charged with DUI.
  • An officer can request a urine sample if they do not believe the machine result.
